These terms govern your use of www.giovastudio.com and any services you book through it. By using the Website you agree to them. If you do not agree, please do not use the Website.
1. Eligibility
You must be at least eighteen years old, or have the legal capacity to enter a binding contract in your jurisdiction.
2. Use of the Website
Use the Website lawfully and in a way that does not restrict anyone else's use of it. You may not transmit malicious code, engage in fraudulent or illegal activity, interfere with how the Website functions, or impersonate another person or entity.
3. Intellectual property
All content on this Website, including text, images, video, logos, and design, is the property of Giova Studio LLC and is protected by copyright and trademark law. Do not reproduce, distribute, or reuse it without our written permission.
Photographs remain our copyright after delivery. Clients receive a licence to use their images as described in their session agreement.
4. Booking and payment
Bookings are subject to availability. Sessions are scheduled on Wednesdays and Thursdays.
A deposit of fifty percent is required to reserve a date. No date is held, blocked, or reserved until the deposit clears.
The deposit is non refundable. The remaining balance is due on delivery of your completed gallery.
Images are released and download links activated once the invoice is paid in full.
Payment is processed by a third party provider. By paying, you accept their terms as well as ours.
Rescheduling with at least forty eight hours notice is accommodated at no charge, and your deposit transfers to the new date. Cancelling forfeits the deposit.
Your signed session agreement governs the specifics of your booking. Where these terms and your signed agreement differ, the signed agreement controls.
5. Website content and pricing
We aim to keep rates and session details on this Website accurate and current. Published rates may change. The rate quoted in your written proposal is the rate that applies to your booking.
6. Limitation of liability
To the fullest extent permitted by law, Giova Studio LLC is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Website, including loss of data, loss of revenue, or business interruption.
7. Indemnification
You agree to indemnify and hold harmless Giova Studio LLC, its employees, contractors, and agents from claims, liabilities, damages, or expenses arising from your use of the Website or your breach of these terms.
8. Changes
We may modify these terms or discontinue any part of the Website at any time. Changes take effect when posted. Continued use constitutes acceptance.
9. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved exclusively in the state or federal courts located in Morris County, New Jersey.
